| | | It could also be transmitting on the FM band either near 88 or 108Mhz. Put it together and set it next to a TV or something with constant sound and go in the next room and tune a radio and listen for it. If you hear it, you have the frequency.
The next step is to slowly move away from the transmitter in a straight line and figure out the range. Once you have the maximum usable range, you can determine the area the receiver might be in or has been in.

| | | alkaline battery, 1.5v each. Non-rechargable. Good life if the transmitting power is kept low... as in ~50milliwatts., meaning they planned on leaving that there for awhile. And also meaning they had to be close.
You might want to walk around outside the restaurant with that in the palm of your hand. Look for people in a car possibly using the car radio to listen. If you get close and the radios output is picked up on the bug, you'll get an obvious feedback through their speakers and you know you have them.

| | | Another reason is FM transmitters are cheap and common and don't require any licensing under a certain power. And your car radio is already an uber-powerful receiver... an earpiece would not really pack much input power.
