If you do assembly development, you'll understand where these come from. Every CPU has tons of bugs and holes in their errata. There are plenty of articles on this. I believe I even posted one here a long time ago about the Intel or AMD CPUs.
These are actually bugs in the CPU itself, not the BIOS or OS. It's permanent. The only solution is to buy a CPU that has the bug fixed. This guy isn't planning to demonstrate it until later, but it may be a good thing. If he releases this and the source, it's going to force processor developers to have to put more time, effort, and quality into designing their chips to prevent something like this. It has went unfixed for so long because no one has done anything about it, and without any kind of tools out there for it, they really didn't have a reason to fix it.
I don't know how it works, but if I were to take a guess then I'm going to say it's written in assembly. This way they can use the errata directly. Since you can run assembly in any operating system, it can affect any operating system.
I'm sure the code that the guy will release will be a proof-of-concept and nothing harmful, but you can be sure the moment it's released that other people in the world will already be writing it into their viruses and trojans.

I don't have a problem with the guy demonstrating this for the purpose as you said getting the processor manufactures to fix this problem, but you can't tell people how to do it for the millions upon millions of computers that have this problem, and as you said, can't be fixed. The only way that could happen, is if the manufacturers or sellers, offered to replace the chips for free. Which means I would be expecting a new CPU from Intel or Apple, and I would fully expect them to install it in my laptop.
